Version 1.0 – In force as of 09/08/2026
Preamble
These general terms of use (hereinafter the “Terms of Use”) set out the terms and conditions for accessing and using the EPI Manager service (hereinafter the “Service”), published by:
UN SITE À VOUS, sole proprietorship (EI), SIRET 904 378 866 00027, 60 rue François 1er, 75008 Paris, France, EU VAT number FR 50904378866 (hereinafter the “Publisher”).
The Terms of Use apply to every user of the Service (hereinafter the “User”), whether they have a free or paid account, as soon as their account is created. They complement the General Terms of Sale, which specifically govern the commercial and pricing aspects of paid subscriptions, and the Privacy policy, which governs the processing of personal data. In the event of a conflict between the Terms of Use and the Terms of Sale on a commercial matter, the Terms of Sale prevail; on the terms of use of the platform, the Terms of Use prevail.
Reference language: these Terms of Use are drafted in French and translated, for information purposes, into the other languages available in the application. In the event of any discrepancy in interpretation between the French version and a translation, the French version alone shall prevail.
Article 1 – Access to the Service
Access to the Service requires the creation of a user account with a valid email address. This address is verified at registration by means of a confirmation link or code sent by email: the account is only fully activated after this verification.
The Service is accessible via a web interface, with offline consultation possible for previously synchronized data. The availability of the Service may be affected by maintenance operations, technical incidents or cases of force majeure. The Publisher uses reasonable means to ensure the continuity of the Service, without however committing to a quantified availability rate.
Article 2 – Organizations, roles and responsibilities of Users
The Service makes it possible to create one or more “organizations” (organization, club, company, association or personal use), within which several Users can collaborate with different roles.
Organization manager: the person who created an organization, or who has been designated as such, is its manager. The manager alone is authorized to invite members, assign roles and remove members from their organization. They are responsible for properly managing access to their organization and for the consequences of the invitations they send.
Responsibility for content created: each User is responsible for the data and content they create or import into the Service (equipment records, documents, photos), under the authority and responsibility of the organization to which they belong – in particular their employer when the use takes place in a professional context.
Responsibility of the inspector: when a User carries out and signs an inspection in the Service, they assume their own responsibility, including with regard to the applicable regulations, for the compliance and condition of the equipment they have inspected. The electronic signature of the inspection record (see Article 5) constitutes a personal certification of this inspection by its author. The Service is a tool to assist with this task and does not replace the professional judgment of the inspector.
Article 3 – Content uploaded by the User
The User undertakes to upload to the Service (documents, photos, references, etc.) only content for which they hold the rights or authorization to use, and not to infringe the rights of third parties (copyright, image rights, trade secrets, etc.), including when such content is only visible to themselves and the members of their organization.
The Service is not a public sharing space: content uploaded by a User is only accessible to the authorized members of their organization(s), according to the roles defined by the manager. The Service offers no feature for publishing or publicly distributing content.
The User remains solely responsible for the content they upload. The Publisher does not carry out any prior moderation of this content, as it consists of data for strictly private use, internal to the Users’ organizations.
Article 4 – Prohibited uses
The User undertakes not to:
- attempt to gain unauthorized access to the Service, its servers or the accounts of other Users;
- massively extract or copy (scraping) data from the Service by automated means not provided for by the Service;
- resell, sublet or transfer access to their account to an unauthorized third party;
- use the Service for the purpose of developing a competing service;
- decompile, reverse engineer or disassemble the Service, except where expressly permitted by law;
- disrupt the normal operation of the Service or compromise its security.
Any breach of these undertakings may result in the suspension or termination of the User’s account under the conditions of Article 7.
Article 5 – Electronic signature and identity verification
Certain actions in the Service, in particular the signing of inspection records, require enhanced verification of the signatory’s identity by means of a validation code sent by email, in addition to the email verification carried out at registration (Article 1).
The technical terms of this electronic signature (digital fingerprint of the document, integrity verification link) and its legal scope are described in the Terms of Sale (Article 9). The User acknowledges that the validity of this verification depends on their exclusive control over their email inbox and undertakes not to disclose the codes received to any third party.
Article 6 – Usage quotas
The Service applies a usage quota on the number of pieces of equipment managed per organization, according to the subscription plan chosen – Perso, Pro or Asso (clubs) –, the details of which are given on the Pricing page of the website. No other technical quota (number of users, requests, imported documents, etc.) is currently applied by the Service. The Publisher reserves the right to introduce, where necessary, other technical limits required for the proper operation of the Service, subject to informing the Users concerned beforehand.
Article 7 – Suspension and termination of access
The Publisher may suspend or terminate, without notice, the access of a User or an organization to the Service in the following cases:
- failure to comply with these Terms of Use, in particular the prohibited uses listed in Article 4;
- uploading of unlawful content or content infringing the rights of third parties;
- fraudulent behavior or attempts to compromise the security of the Service or of other Users;
- manifestly abusive use of the Service or use diverted from its purpose.
This suspension or termination is independent of that provided for by the Terms of Sale in the event of non-payment, which follows its own terms described in Article 6 of the Terms of Sale (switch to the free tier, without deletion of the account or data for that reason alone).
Article 8 – Intellectual property
The intellectual property rights relating to the Service (software, interfaces, database, documentation, EPI Manager trademark) remain the exclusive property of the Publisher. The Terms of Use grant the User no rights over these elements other than the right to use the Service described in Article 10 of the Terms of Sale.
Article 9 – Changes to the Service and the Terms of Use
The Publisher may change the features of the Service as well as these Terms of Use, in particular to take account of legal, regulatory or technical developments. Any substantial change to the Terms of Use will be notified to Users before it comes into force, under the same notice conditions as those provided for in the Terms of Sale (Article 12).
Article 10 – Applicable law and disputes
These Terms of Use are governed by French law. The applicable terms for amicable dispute resolution and consumer mediation are those described in Article 13 of the Terms of Sale, which also apply to disputes relating to the use of the Service under these Terms of Use.
