Version 1.3 – In force as of 10/23/2026
Preamble
These general terms of sale (hereinafter the “Terms of Sale”) govern the contractual relationship between:
UN SITE À VOUS, sole proprietorship (EI), registered under SIRET number 904 378 866 00027, whose registered office is located at 60 rue François 1er, 75008 Paris, France, EU VAT number FR 50904378866, represented by its owner (hereinafter the “Publisher”),
and
any natural or legal person using the EPI Manager service or subscribing to it (hereinafter the “Customer”).
These Terms of Sale apply to all EPI Manager plans – “Perso”, “Pro” and “Asso” (clubs) –, whether free or paid, regardless of the subscription channel. They prevail over any other document of the Customer, in particular their general terms of purchase, unless otherwise agreed in writing in advance by the Publisher.
B2B / B2C distinction: when the Customer is a consumer within the meaning of the preliminary article of the French Consumer Code (a natural person acting for purposes outside their professional activity), the clauses identified as “Consumer Clause” apply in addition to or by way of derogation from the general clauses. For professional Customers (companies, associations, self-employed persons acting in a professional capacity), the clauses identified as “Professional Clause” apply where relevant.
Article 1 – Purpose of the service
EPI Manager is SaaS (Software as a Service) software for managing personal protective equipment (PPE) and tracking its inspections.
The features of the service and those included in each plan are described on the Publisher’s website, on the Features and Pricing pages.
The Publisher may change the features of the service, in particular to improve it or adapt it to changes in standards, without this constituting a substantial change as long as equipment fleet management and inspection tracking are maintained.
Article 2 – Plans, free offers and prices
Plans: the service is offered in three plans, “Perso” (individuals), “Pro” (professionals) and “Asso” (clubs and associations), each available as a monthly or yearly subscription with recurring billing. The content and price of each plan are shown on the Pricing page; the applicable price is the one displayed at the time of subscription.
Free tier: the first organization created by an account benefits, with no time limit and no payment, from a free equipment tier whose volume, specific to each plan, is shown on the Pricing page. Subsequent organizations do not benefit from it and require a paid subscription from their first piece of equipment. For this reason, the first organization of an account cannot be deleted.
Trial period: for two (2) months from the creation of their account, the Customer has free access, for the organizations they have created, to all the features of their plan, including paid features. The trial does not change the number of pieces of equipment allowed, requires no means of payment and does not lead to any automatic subscription: at the end of the trial, without a paid subscription, the paid features are no longer accessible and the Customer’s data is kept.
Number of pieces of equipment: the number of pieces of equipment in an organization is limited to its free tier or to the tier purchased. Once this limit is reached, the creation of new equipment is blocked until an additional tier is purchased; no overage is billed automatically.
Prices: prices are expressed in euros excluding tax; VAT at the applicable rate is added at invoicing. Consumer Clause: the price including all taxes is displayed before payment is confirmed.
Price changes: the Publisher may change its prices at any time. Any change is notified to the Customer at least thirty (30) days before it comes into force and only applies from the next renewal of the current subscription. A Customer who refuses it may cancel their subscription before that date, under the conditions of Article 6.
Article 3 – Payment terms
Payments are processed by the provider Stripe. The Customer authorizes the Publisher to automatically charge, via Stripe, the amount of their subscription according to the chosen frequency (monthly or yearly), until it is cancelled.
If a payment fails, the Customer is notified by email. If the situation is not remedied, the Publisher may end the paid subscription: the organization then reverts to its free tier (none for an organization other than the first one of the account), its data is kept, but the creation of equipment beyond this tier and the paid features are no longer accessible.
Article 4 – Formation and term of the contract
The contract is formed as soon as the Customer accepts these Terms of Sale and, for a paid subscription, as soon as their payment is confirmed.
A paid subscription is concluded for the chosen period (monthly or yearly) and is renewed automatically for periods of the same duration, unless cancelled under the conditions of Article 6.
Article 5 – Right of withdrawal (Consumer Clause)
Beneficiaries: the right of withdrawal is reserved for consumer Customers, i.e. individuals who have taken out a paid subscription for a “Perso” organization. Subscriptions taken out for a “Pro” or “Asso” (clubs) organization do not benefit from it.
Time limit: in accordance with articles L221-18 and L221-19 of the French Consumer Code, the consumer Customer has fourteen (14) days from their first payment to withdraw, without giving any reason and without penalty. The day of payment is not counted: the period expires at the end of the fourteenth day that follows.
Immediate access without waiver: the paid features are accessible as soon as payment is confirmed, without the Customer waiving their right of withdrawal or owing anything for the use of the service during this period.
Exercise: the Customer exercises this right from the “Subscription” page of their account (“Request withdrawal” link, available throughout the period), or by sending the Publisher, before the period expires, any unambiguous statement, for example the model form in the appendix, to contact@epi-manager.fr. The Publisher acknowledges receipt by email without delay.
Effects and refund: withdrawal immediately ends the paid subscription; the organization reverts to its free tier and the Customer keeps their data. In accordance with article L221-24 of the French Consumer Code, the Publisher refunds all sums paid, free of charge, no later than fourteen (14) days after being informed of the withdrawal, using the means of payment used for the initial transaction.
Referral codes and club codes: the benefits attached to a referral code or a club code are only granted after a period of fourteen (14) days following the first payment of the referred person or member, whatever the type of Customer, and are not granted if that person withdraws. The benefit of a referral code is one (1) free month for the holder of the code and the referred person. The benefit of a club code is, for the member, a fifteen per cent (15%) discount on their subscription until the code expires and, for the “Asso” structure holding the code, one (1) step of fifty (50) items of equipment for each member who has taken a paid subscription with that code, deducted from the next renewal invoice of its subscription. This deduction may not exceed the amount of the invoice concerned and gives rise to no refund or payment. A code is only issued to a Customer holding a paid subscription.
A new paid subscription concluded after the end of a previous paid subscription opens a new withdrawal period. Changes to a current subscription (plan, number of pieces of equipment, frequency) do not.
Article 6 – Cancellation
Cancellation by the Customer: the Customer may cancel their paid subscription at any time from the “Subscription” page of their account or by contacting the Publisher. Cancellation takes effect at the end of the period already paid for, until which the Customer keeps the paid features, without refund for that period, subject to the right of withdrawal provided for in Article 5.
Cancellation does not result in the deletion of the account or the data. When it takes effect, the organization reverts to its free tier, under the conditions of Article 2.
Cancellation for non-payment: it follows the terms of Article 3, without prejudice to any sums still due.
Deletion of the account and data: the Customer may at any time request the permanent deletion of their account and data. All their data is then deleted, with the exception of the supporting documents for any payments (invoices, billing information), which the Publisher is legally required to keep for ten (10) years from their issue.
Article 7 – Data export
The Customer may at any time export the list of their equipment in CSV or XLSX format. The other data specific to the operation of the service (assemblies, complete history of inspections and outings, settings) cannot be exported.
Article 8 – Liability
EPI Manager is a tool to help manage PPE and track its inspections. It in no way replaces the Customer’s legal and regulatory obligations, in particular those of the employer regarding the periodic inspection of PPE. The Customer remains solely responsible for:
- compliance with the standards and regulations applicable to their activity and equipment;
- the accuracy and updating of the information entered in the service;
- decisions taken on the basis of the information and alerts provided by the service, the Publisher not guaranteeing the completeness or accuracy of the built-in standards references.
The Publisher provides the service with diligence and in accordance with professional standards, without any quantified availability commitment.
Professional Clause: to the extent permitted by law, the Publisher’s liability towards a professional Customer is limited to direct damage and may not exceed the amount paid by the Customer during the twelve (12) months preceding the event giving rise to liability. The Publisher is not liable for indirect damage (operating loss, commercial loss, loss of data not attributable to its fault, etc.).
Consumer Clause: these limitations do not exclude the Publisher’s liability in the event of gross negligence or willful misconduct and do not affect the rights granted to consumers by law.
Article 9 – Electronic signature of inspection documents
The signature of inspection documents offered by the service is a so-called “simple” electronic signature within the meaning of Regulation (EU) No 910/2014 (eIDAS). Its evidential value is reinforced by a validation code sent by email to the signatory and by a digital fingerprint of the signed document, which makes it possible to verify its integrity.
It does not benefit from the presumption of reliability of qualified signatures, but constitutes admissible evidence, whose probative value is assessed by the court. The Customer remains the sole judge of whether this solution is suited to their needs, in particular regulatory ones.
Article 10 – Intellectual property
The Publisher retains all intellectual property rights attached to the EPI Manager service (software, interfaces, source code, database, documentation). The Customer is granted a personal, non-exclusive and non-transferable right to use the service for the term of the contract, excluding any reproduction, decompilation or extraction not authorized by law.
The data entered by the Customer remains their property; they retain full responsibility for it and may export it under the conditions of Article 7.
Article 11 – Personal data
The processing of personal data is described in the Privacy policy, a separate document that complements these Terms of Sale.
The service’s data is hosted in France, by o2switch.
Article 12 – Changes to the Terms of Sale
The Publisher may change these Terms of Sale, in particular to adapt them to legal, regulatory or functional changes to the service. Any substantial change is notified to the Customer at least thirty (30) days before it comes into force; continued use of the service after that date constitutes acceptance. A Customer who refuses it may cancel their subscription under the conditions of Article 6.
Article 13 – Disputes, mediation and applicable law
These Terms of Sale are governed by French law.
For any complaint, the Customer contacts the Publisher at contact@epi-manager.fr or by post at the address given in the preamble. The parties seek an amicable solution before taking any legal action.
Consumer Clause: the consumer Customer may use, free of charge, the consumer mediator designated by the Publisher, Médiation de la Consommation Fevad (MCF): https://www.mediateurfevad.fr. Failing an amicable settlement, the dispute is brought before the competent courts in accordance with ordinary law.
Professional Clause: any dispute with a professional Customer that has not been settled amicably falls under the exclusive jurisdiction of the courts of Paris, unless otherwise provided by mandatory legal provisions.
Appendix – Model withdrawal form (Consumer Clause)
Form to be completed and returned only if the consumer Customer wishes to withdraw without using the “Request withdrawal” link in their account (articles L221-5 and R221-1 of the French Consumer Code).
